Agreement
These terms apply when you play a game published by Niyati Games or use this website, niyatigames.com. By doing so, you agree to them. If you don’t agree, please don’t use our games or website. Our Privacy Policy explains how we handle information.
The store you downloaded a game from (for example Google Play) also has its own terms, which apply alongside these. Nothing in these terms limits rights you have under consumer law that cannot be excluded.
Who we are
Niyati Games is an independent mobile game studio from India.
Playing our games
We give you a personal, non-exclusive, non-transferable, revocable licence to download and play our games on devices you own or control, for your own non-commercial entertainment. You don’t own the games; you have a licence to play them.
Fair play
When you play, please don’t:
- cheat, or use bots, hacks, modified clients or other unauthorised software;
- exploit bugs, or copy, decompile, reverse engineer or modify our games, except where the law allows it;
- interfere with our games, servers or other players;
- use our games for anything unlawful, or to sell, rent or commercially exploit them.
Purchases and virtual items
Some games may let you buy virtual items or currency. Purchases are made and processed through the app store, under its payment terms. Virtual items are part of your licence to play: they have no cash value and can’t be exchanged for real money, sold or transferred.
Refunds are handled under the app store’s refund policy and any rights you have under law. If something you bought doesn’t arrive, email support@niyatigames.com with the game name and your order number.
Ads and third-party services
Some of our games show ads served by third parties.
Our games and website may link to or include services run by others, such as app stores and the services listed in our Privacy Policy. Those services are governed by their own terms, and we aren’t responsible for them.
Our intellectual property
Our games, the Niyati Games name and logo, the Destiny Line and everything on this website belong to Niyati Games or its licensors. You may not use them without our written permission, except to share links to our games and website.
Updates and availability
We may update, change or stop offering any game or feature at any time, for example to fix issues, improve balance or comply with the law. We will try to give reasonable notice before closing a game in which you have bought items.
Disclaimer
We make our games with care, but they are provided “as is” and “as available”. To the extent the law allows, we don’t promise that they will always be available, uninterrupted or free of errors.
Limitation of liability
To the extent the law allows, Niyati Games is not liable for indirect, incidental or consequential losses, or for loss of data or profits, arising from your use of our games or website. Our total liability to you for any claim is limited to the amount you paid us for the game or item concerned in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Ending these terms
You can stop using our games at any time by deleting them. We may suspend or end your access if you seriously or repeatedly break these terms.
Governing law
These terms are governed by the laws of India. This doesn’t take away any right you may have to bring a claim in the courts where you live.
Changes to these terms
If we change these terms, we will update the effective date at the top of this page. If a change is significant, we will also tell you in our games or on this website. If you keep playing after a change, the new terms apply.
